In the United Kingdom, the Dynamic Purchasing System (DPS) is gradually emerging as a popular tool for regulated procurement. The tool has become particularly relevant, as many authorities see it as offering them a dynamic and flexible engagement route to meet their requirements. Focusing on the rules on DPS in the previous European Union (EU) public procurement directives, the rules on DPS in the current EU public procurement directives and evidence from contracting authorities in the UK on their experiences with DPS, this article seeks to contribute to the existing literature on DPS. The discussion extends the analysis beyond the existing doctrinal discussions, by drawing upon the experiences of contracting authorities to argue for enhanced reform to the legal rules and practical guidance on aspects of DPS operation that remain unclear.
